Site and enclosure dimensions
Pools and swim spas belong in the side or rear yard. The enclosure must fully surround the water area, be at least 1.5 m high and stand at least 1.2 m from the pool edge.
The posted section limits openings to 100 mm and chain-link diamond mesh to 50 mm. It gives further horizontal-rail rules under Section 41. Read the complete section and enclosure brochure before choosing a fence product.

Application evidence
Provide the completed Development Permit form and a site plan showing boundaries, buildings, pool or spa, enclosure, edge-to-fence distances, fence heights, lengths, materials and gates.
Show compliance by annotated sketch, notes or photographs as appropriate. Easement consent and WAWA approval may be required. A pool is usually not allowed inside a registered easement, even if a fence can be approved there.

Construction and review
The city says installation before enclosure completion is subject to Section 41(4). This is not a blanket permission to leave a filled pool unprotected. Confirm the construction sequence with Planning.
Apply on the second floor of 655 Main Street, by mail or info.plans@moncton.ca. The project-section residential Development Permit fee is $43;staff confirms the category and other required permits.
